FinCEN Continues to Target Real Estate as Fraud Hub

Luxury real estate isn’t always purchased with clean money. The issue flagged by the U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) is how transnational networks, including Chinese money movers and Mexican cartels, use property purchases to launder illicit cash.

This new focus comes from FinCEN’s September 2025 advisory and Financial Trend Analysis. More than 17,000 Bank Secrecy Act reports identified $53.7 billion in suspicious real estate transactions. Networks typically move drug proceeds or corrupt funds through intermediaries, convert cash to cashier’s checks, and funnel those checks into property purchases. FinCEN’s new rule, requires title and settlement professionals to report certain non-financed transfers to entities or trusts.

The analysis makes the risk vivid. Imagine cartels using suburban homes to wash drug money, driving up local prices while keeping transactions looking legitimate. While the government frames this as a threat to the financial system, industry groups warn of high compliance costs, particularly for small title companies. Still, the data show billions already flowing into U.S. housing, distorting markets.

The conclusion is that real estate is now squarely on the front lines of anti-money laundering enforcement. For real estate consumers, the lesson is that hidden criminal money can warp housing markets, pushing prices out of reach. Transparency rules help protect ordinary buyers and restore trust.

For real estate professionals, it’s time to prepare for the new reporting requirements under the Real Estate Reporting Form. This new law will require reporting by settlement service providers on many residential real estate transactions. Originally slated to go into effect December 1, 2025; FinCEN has announced a temporary order granting exemptive relief from the reporting requirements until March 1, 2026. They have also finalized the reporting requirements. As such, now is the time to get your system in place to report come early 2026.
